...whereby each of the said parties will be entitled to have and take from the produce and proffits thereof one equal third part or three equal parts thereof...
And whereas it is convenient to the said David Thornley to advance and put into the said joint stock a full equal share of money with his partners...the said David Thornley hath applied to the said John Smalley to advance and lend him such sum and sums of money from time to time during the continuance of the said copartnership as shall make the joint capital and stock of him and the said David Thornley equal in value to the joint stock or share of the said Richard Arkwright...the said David Thornley hath bargained, sold assigned, transferred and set over unto the said John Smalley.... All that ninth part in share (the whole into nine equal parts being divided) of and in the yearly proffits and produce of the said business during the term of the said partnership... |
